How DailyKarma Ensures Your Compliance with CA AB488

California's Assembly Bill 488 (CA AB 488) will be fully enforced in 2025, introducing stricter oversight of cause marketing campaigns and charity platforms. This law aims to enhance transparency and accountability in fundraising initiatives.

To help you navigate these changes, we've analyzed the bill and distilled the key points directly relevant to your give-back campaigns on DailyKarma.

Action Required:
Review the details below carefully and take any necessary steps to ensure your campaigns remain compliant with this new legislation.

What is changing January 2025

  1. Nonprofits must be registered with our donation distribution partners Change (https://getchange.io) to be  included in Portion of Sales and Point of Sale campaigns. When you select your nonprofits in these campaigns, you will only be able to select nonprofits that have granted permission. This database features 5,500 top-rated and trending U.S. charities.

  1. Nonprofits that have not registered CAN be included in all other campaign types, provided the customer is notified that the process of granting permission has not been completed. We have added this required notification to the Choose Causes / Learn More screen for you. It will only appear if you select one or more nonprofits that have not registered. Once a nonprofit claims their account at https://api.getchange.io/sign_in , we will remove the notification for you.

  1. Nonprofit logos cannot be used for nonprofits that have not claimed their account and uploaded their logo. These will be replaced by default category logos until permission is obtained.

  1. Nonprofits that have completed the process of registering  are indicated by the “Permission Granted” flag on the Browse Nonprofits screen in your dashboard.

  1. To maintain compliance and ensure donations reach properly vetted international charities, all international organizations must now be onboarded and vetted through GlobalGiving. You can explore the full list of approved charities at GlobalGiving.org. International charities that are not on this list will be removed from the DailyKarma system. If you’d like to support an international cause, please review GlobalGiving’s list and let us know your preferred charity. We’ll swiftly add it to our system so you can incorporate it into your campaigns.

  2. The product information that appears on the donation product on checkout, customer order summary and receipt has been updated to comply with the new law. It is important that you do not change this text, as doing so may affect your compliance status.

What you need to do

  1. Check your Portion of Sales campaigns

On January 27, 2025, we will remove nonprofits that have not claimed their account at Change from all Portion of Sales campaigns. If a campaign also includes registered  nonprofits, the campaign will remain active with those nonprofits. If the campaign only supports nonprofits that have not granted permission, it will be disconnected.

  • Before January 27, 2025 – In each of your active Portion of Sales campaigns, please view the “Select Nonprofit” section to view the nonprofits you have set for each campaign. Nonprofits that will be removed from campaigns on January 27, 2025 will be highlighted in “Your added nonprofits”.

  • Remove these nonprofits and replace them with nonprofits that include the “Permission Granted” flag in the browse screen.

  • After January 27, 2025 – Check your Portion of Sales campaigns. If they have been disconnected, you need to select one or more nonprofits that have registered and appear in our database. Then you may reconnect the campaign(s).

  1. Check your Point of Sale campaigns for Brick and Mortar locations

On January 27, 2025, we will introduce the “Point of Sale” checkbox on each campaign that is supported for In Store Point of Sale campaigns.

If this checkbox is selected, nonprofits that have not registered cannot be selected. We will remove nonprofits that have not granted explicit permission from all campaigns used at Point of Sale. If a campaign also includes approved nonprofits, the campaign will remain active in the Point of Sale app with those nonprofits only. If the campaign only supports nonprofits that have not granted permission, it will be disconnected.

  • Before January 27, 2025 – Use the “Select Nonprofit” section to view the nonprofits you have set for any campaigns you are using in Point of Sale. Nonprofits that will be removed from campaigns on January 27, 2025 will be highlighted in “Your added nonprofits”. Remove these nonprofits and replace them with nonprofits that include the “Permission Granted” flag in the browse screen.

  • After January 27, 2025 – Check campaigns that you have been using in the Point of Sale app. If they have been disconnected, you need to select one or more nonprofits that have provided permission and reconnect the campaign(s). If they have not been disconnected, check the nonprofits listed for the campaign and replace any that have been removed with eligible nonprofits, if desired.

Note, this only applies to Portion of Sales and Point of Sale campaigns. Nonprofits that have not yet granted permission can still benefit from your Donation Tiers, Round Up, $1 Donation, Custom Amount, Donate for Discount and Donate for Gift campaigns through your online store.

  1. Check your campaign logos

  • After January 27, 2025 – Check campaigns that are displaying logos to see if they have been replaced by default category logos and decide if you wish to remove these logos or change nonprofits.
